1. Introduction
Welcome to Church Note, a software platform designed to transform pastors' sermon notes into comprehensive discussion guides. These Terms and Conditions govern your use of Church Note, particularly focusing on the text generated by our platform, herein referred to as "Generated Content."
2. Acceptance of Terms
By using Church Note, you agree to be bound by these Terms and Conditions, our Privacy Policy, and any other relevant documents. If you do not agree to these terms, you must not use our services.
3. Intellectual Property Rights
a. Ownership: The Generated Content created by Church Note, including but not limited to text, graphics, and underlying technology, is the property of Church Note or its licensors. Except as expressly permitted by these Terms, no part of Church Note's services or Generated Content may be copied, reproduced, distributed, republished, downloaded, displayed, posted, or transmitted in any form or by any means.b. User Contributions: Pastors or users who submit their sermon notes for conversion into discussion guides retain ownership of their original content. However, by submitting such content, you grant Church Note a worldwide, perpetual, irrevocable, royalty-free license to use, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in connection with the services provided by Church Note.
ntellectual Property Clause for Church NoteOwnership of Intellectual Property: All software, technology, programs, materials, inventions, processes, and innovations developed, created, or used by Church Note, including but not limited to the software platform that turns a pastor's sermon notes into a discussion guide (hereinafter referred to as “the Software”), are the exclusive property of Church Note or its licensors. This includes, without limitation, all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics.Generated Content Ownership: The text, content, and materials generated by the Software, including but not limited to discussion guides created from a pastor's sermon notes (hereinafter referred to as “Generated Content”), are the intellectual property of Church Note. Users are granted a limited, non-exclusive, revocable license to use Generated Content for their personal, non-commercial use within their congregations or study groups.Restrictions on Use: Users may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Software, including the Generated Content, except as follows:Users may temporarily download a copy of Generated Content to a computer or mobile device for personal, non-commercial viewing and use within their congregation or study group.Users must not:Modify the copies of any Generated Content from the Software.Use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text.Remove any copyright, trademark, or other proprietary notices from materials found in the Software or Generated Content.Share, sell, or distribute Generated Content outside their congregation or study group without express written permission from Church Note.Intellectual Property Protection: Church Note reserves all rights not expressly granted to the user in and to the Software and Generated Content. Unauthorized use, reproduction, modification, distribution, or storage of any content on the Software for purposes not expressly permitted by this agreement is strictly prohibited and may violate applicable copyright and trademark laws.Termination: Church Note reserves the right to terminate a user's license to use the Software and Generated Content at any time and for any reason, including the breach of this intellectual property clause. Upon termination, the user must cease all use of the Software and destroy all copies of Generated Content obtained from the Software.This clause is intended to protect the intellectual property rights of Church Note while allowing users to benefit from the Software in their religious and educational activities. Creation of Additional Study Guides and Materials: Should a pastor, church, or any user wish to create additional study guides, accompanying book/study guide materials, or any derivative works based on the Generated Content, Church Note offers this service separately. Recognizing the value and potential need for customized educational materials tailored to the specific teachings and needs of individual congregations, Church Note is committed to providing support and assistance in the development of such materials. Interested parties are encouraged to reach out directly to Church Note to discuss their needs and explore the services available. 4. Use of Generated Contenta. Permitted Uses: Church Note grants you a non-exclusive, non-transferable, revocable license to access and use the Generated Content for your personal, non-commercial use, specifically for leading discussions within your community or congregation.b. Restrictions: You agree not to use the Generated Content for any unlawful purpose, in any way that violates the rights of others, or in any manner inconsistent with these Terms and Conditions.5. User Responsibilitiesa. Content Guidelines: You agree to ensure that any content you submit to Church Note for processing does not infringe on the intellectual property rights of others, contain defamatory material, or otherwise violate any legal standards.b. Accuracy and Integrity: While Church Note strives to ensure the accuracy and integrity of Generated Content, users are responsible for reviewing and confirming the accuracy and applicability of the content within their specific contexts.6. Disclaimers and Limitation of Liabilitya. No Warranties: Church Note provides its services and Generated Content "as is" and without any warranties, express or implied. Church Note does not guarantee that the services or Generated Content will meet your requirements or be available on an uninterrupted, secure, or error-free basis.b. Limitation of Liability: Church Note, its affiliates, employees, agents, or licensors will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of Church Note services or Generated Content.7.
